General Terms and Conditions of Sale (“GTC”)

2. Purpose and Scope of Application

These General Terms and Conditions of Sale (“GTC”) govern the contractual relationship between Sol-Millennium Europe Sp. z o.o. (“Seller”) and any adult natural person acting for non-professional purposes (“Customer”) wishing to purchase the products offered on the website https://insujet.eu.

The product concerned is a needle-free medical device for the administration of insulin, marketed under the name InsuJet™.

These GTC apply to all InsuJet™ products offered on the site, including:

  • The InsuJet™ starter kit, which includes the injector and initial nozzles/adapters.
  • Replacement nozzles and adapters sold separately as consumables (collectively, the “Products”).

The list of Products is regularly updated on the Site.


3. Product Delivery

Products are shipped to the delivery address specified by the Customer via an approved logistics carrier.

Estimated delivery time: 2–5 business days (excluding stock shortages or force majeure).

Delivery terms, costs, and tracking details are confirmed at checkout and by email after dispatch.


4. Price

Prices are stated in euros (€), inclusive of VAT, and exclusive of shipping or service fees unless otherwise indicated. The applicable price is that in force on the date of order confirmation. The Seller reserves the right to amend prices at any time without retroactive effect.


5. Ordering

Orders are placed online via the following steps:

  1. Product selection
  2. Entry of contact and delivery information
  3. Secure payment
  4. Order confirmation by email

The Customer must ensure the accuracy of all data provided. Any delivery failure resulting from incorrect information is the Customer’s responsibility.

The Seller reserves the right to reject any order that appears abnormal, fraudulent, or inconsistent with ordinary consumer use.


6. Product Subscriptions

Customers may subscribe to receive selected Products automatically (e.g., InsuJet™ consumables) at regular intervals.

Subscription terms:

  • Available monthly, bimonthly, or quarterly.
  • Managed via the Customer’s personal account (modification, suspension, cancellation).
  • Non-binding; can be canceled at any time up to 48 hours before the next scheduled shipment.
  • Payment is processed at each renewal date.
  • Conditions and pricing are displayed at the time of subscription.

The Seller reserves the right to modify or discontinue the subscription service with reasonable prior notice to Customers.


7. Payment

Payment is due in full at the time of ordering.

Accepted payment methods:

  • Bank cards (Visa, Mastercard, etc.) via a secure gateway
  • PayPal
  • Payment in installments via Alma, subject to acceptance and conditions of that provider

Payment security is ensured by certified third-party providers using SSL encryption and anti-fraud measures. The Seller does not store bank card data.


8. Product Use Training

To ensure safe and correct use of the Product, Sol-M Europe provides several training options available at or after purchase:

  • Online videos — accessible in the “Instructions for Use” section.
  • Group webinars — live sessions with demonstration and Q&A.
  • Individual videoconference — remote session with a healthcare professional (on request).
  • In-home training — provided by a licensed nurse through partner networks.

All sessions are confidential, and no recordings are made. These services help Customers use InsuJet™ independently and safely.


9. Right of Withdrawal

a) Statutory Period

Under Directive 2011/83/EU on Consumer Rights, Customers have 14 days from receipt of the Product to withdraw without giving any reason and without incurring costs other than return shipping.

Withdrawal can be requested:

  • Via the website contact form, or
  • By email using a model withdrawal form available on the Site.

Returned Products must be in their original, unopened packaging, unused, and accompanied by the invoice. Any opened or used Product cannot be refunded.

b) Exception – Medical Products

Pursuant to Article 16(e) of Directive 2011/83/EU, the right of withdrawal does not apply to sealed goods unsealed after delivery that cannot be returned for health-protection or hygiene reasons. Therefore, any unsealed InsuJet™ Product is not eligible for withdrawal.


10. Warranties

InsuJet™ Products comply with EU Regulation 2017/745 on medical devices.

They are covered by:

  • A 2-year legal warranty of conformity.
  • A warranty against hidden defects rendering the Product unfit for its intended use.

Upon delivery, Customers must inspect the Products immediately and report any issues (damage, missing items, incorrect references) within 4 days to serviceclient@insujet.eu.

Any return requires the Seller’s prior approval. If a defect is confirmed, the Product will be replaced or refunded, including return shipping costs.


11. Liability

The Seller shall not be liable for:

  • Misuse of the Product,
  • Failure to follow the instructions for use, or
  • Delays or non-performance due to force majeure.

The Seller is not responsible for indirect or consequential losses (e.g., loss of income, opportunity, or data). Delivery delays attributable to the carrier are excluded from liability where shipment occurred on time.


12. Intellectual Property

All elements of the Site and Products (texts, trademarks, designs, images, videos, and software) are protected by intellectual-property rights held by Sol-M Europe or its partners. Any reproduction, representation, modification, or exploitation, in whole or in part, without prior written authorization is prohibited and may result in legal action.


13. Personal Data

Personal data collected through the Site are processed in accordance with the General Data Protection Regulation (EU 2016/679).

Data are used solely for order management, delivery, customer service, and (with consent) commercial communications.

Customers have the following rights at any time:

  • Access, rectification, erasure, restriction, portability, objection, and complaint to a supervisory authority.

Data are stored for no more than 3 years after the last contact unless a longer period is required by law. Requests may be sent to privacy@insujet.eu. See our Privacy Policy for more details.


14. Contract Archiving

Contracts concluded electronically for an amount of €120 or more are securely archived for 10 years. Customers may obtain a copy by contacting Customer Service.


15. Modification of the GTC

The Seller may amend these GTC at any time. The applicable version is the one in force on the order date. A dated copy can be provided upon request.


16. Applicable Law – Dispute Resolution

These GTC and any related sales are governed by Polish law, subject to the mandatory protections of EU consumer law (Directive 2011/83/EU and Regulation 593/2008 – Rome I).

In the event of a dispute, Customers should first contact Customer Service for an amicable resolution.

If no agreement is reached, Customers may refer the matter to an EU-accredited consumer mediator or use the European Online Dispute Resolution (ODR) platform at https://ec.europa.eu/consumers/odr.

Failing amicable settlement, disputes shall fall under the jurisdiction of the competent Polish courts, without prejudice to the consumer’s right to bring proceedings in their country of residence within the EU.
